Resolution concerning the conclusion of the Transatlantic Trade and Investment Partnership [TTIP]
The “Hellenic Association of Magistrates for Democracy and Freedoms” exresses its deep concern upon what is leaking by the press about the negotiations between the USA and EU, known as Transatlantic Trade and Investment Partnership [TTIP], given the absence of consultation documents.
This agreement has no legal basis and the competence of the EU itself for its conclusion is seriously questioned.
This agreement appears to threaten directly the acquis communautaire, easing the rules governing the food safety, the environment, the climate change, the social and labor rights of European citizens.
The proposed settlement of disputes between investors and Member States by an “arbitration mechanism”, to the exclusion of national courts, affects the core of the rule of law and legal culture of Europe, providing to the economically potent the possibility to negotiate with the European States on equal terms and be compensated directly from them when their interests are affected, outside the framework of the existing substantial and procedural law.
In view of these, the “Hellenic Association of Magistrates for Democracy and Freedoms” invites all citizens and in particular the legal world on alert.
